Decizii
În perioada 1 octombrie-31 decembrie, Consiliul Concurenţei a emis 18 decizii, din care 9 decizii privind operaţiuni de concentrare economică, 4
decizii privind sancţionarea unor carteluri, 2 decizii
privind abuzuri de poziţie dominantă, din care una de
sancţionare, 2 decizii privind acordarea accesului la
documente şi informaţii confidenţiale şi o decizie de recalculare a unei taxe de autorizare pentru concentrare economică.
Cartel:
1. Au fost sancţionate 7 societăţi pentru participarea
pe piaţa serviciilor de cazare şi tratament balnear în staţiunea Băile Olăneşti cu oferte trucate la licitaţia
organizată de CNPAS în vederea atribuirii biletelor
de tratament balnear. Amenda aplicată este de
4.202.303 lei.
2. Corpul Experţilor Contabili şi Contabililor Autorizaţi din România (CECCAR) a fost sancţionat pentru fixarea tarifelor practicate pe piaţa serviciilor de contabilitate de membrii săi. Amenda aplicată este de 4.056.264 lei.

Decisions
During the 1st of October – the 31st of December, the Competition Council has issued 18 decisions, out of which 9 on economic concentrations, 4 for sanctioning certain
cartels, 2 on abuses of dominant positions, out of which
one was a sanctioning decision, 2 for granting access
to confidential documents and information and one for recalculating an authorising tax of an economic concentration.
Cartel:
1. 7 undertakings have been sanctioned for bid
rigging. The tender was organised by the National
House for Pensions and Other Social Security
Grants (CNPAS) for entrusting watering treatment vouchers. The market involved was the market of accommodation and watering treatment services in Băile Olăneşti. The fine applied by the Competition Council has been of Lei 4,202,303.
2. The Body of Expert and Licensed Accountants of Romania (CECCAR) has been sanctioned for fixing the tariffs applied by its members on the market of accounting services. The fine applied by the Competition Council has been of Lei 4,056,264.

3. Au fost sancţionate 10 întreprinderi pentru majorarea
tarifelor pe piaţa serviciilor de transport persoane în regim de taxi în mun. Constanţa. Valoarea cumulată a amenzilor aplicate este de 302.235 lei.
4. Au fost sancţionate 11 firme din Timisoara ce au participat la o înţelegere privind majorarea tarifelor pentru serviciile de transport persoane în regim de taxi. Amenda totală aplicată este de 348.710 lei.
Abuz de poziţie dominantă: Compania Naţională Poşta Romană (CNPR) a fost sancţionată cu amendă în valoare de 103.373.320 lei pentru abuzul de poziţie dominantă pe piaţa serviciilor poştale.
Concentrări economice: au fost adoptate 9 decizii de neobiecţiune1.

3. 10 undertakings have been sanctioned for raising
concertedly the tariffs on the taxi transportation services in Constanţa. The total value of fines has been of Lei 302,235.
4. 11 undertakings operating in Timisoara were sanctioned for concluding an agreement with the aim of increasing the tariffs on the taxi transportation services. The total value of fines has been of Lei 348,710.
Abuse of dominant position: The Romanian National Post Company (CNPR) has been sanctioned with a fine of Lei
103,373,320 for abusing its dominant position on the post services market.
Economic concentrations: 9 non-objection decisions1 were adopted.

Investigaţia în urma plângerii
În urma plângerii a fost declanşată o investigaţie pentru posibila încălcare a art.9 alin.(1) din lege de către Spitalul Clinic Judeţean de Urgenţă Cluj din Cluj-Napoca cu ocazia procedurii de achiziţie publică pentru atribuirea contractului de achiziţie publică/încheierea acordului –cadru pentru achiziţia publică de „Catetere şi consumabile medicale nechimice de unică folosinţă şi consumabile hematologice”, cu data de deschidere a ofertelor în ziua de 19.07.2010.
Investigaţii finalizate/închise
În ultimul trimestru al anului au fost finalizate opt
investigaţii deschise în anii anteriori, după cum urmează:
1. Investigaţia având ca obiect posibila încălcare a prevederilor art.5 alin.(1) din Legea concurenţei şi a art. 101 alin. (1) din Tratatul privind Funcţionarea Uniunii Europene de către CECCAR;
2. Investigaţia având ca obiect posibila încălcare a art.5 alin. (1) din Legea concurenţei nr.21/1996, republicată de către societăţile active pe piaţa serviciilor de cazare şi tratament balnear în staţiunea Băile Olăneşti, participante la licitaţiile organizate de către Casa Naţională de Pensii şi Alte Drepturi de Asigurări Sociale, în vederea atribuirii biletelor de tratament subvenţionate din bugetul asigurărilor sociale de stat;
3. Investigaţia pe piaţa serviciilor poştale cu privire la abuzul de poziţie dominantă al CNPR;

Investigation following a complaint
Following a certain complaint, the Competition Council initiated an investigation on the possible infringement of art.9 (1) of the law by the County Emergency Hospital of Cluj-Napoca. The possible infringement relates to the public acquisition procedure for entrusting the public procurement contract/concluding the public procurement framework contract of “Catheters and disposable non-chemical medical consumables and haematological consumables” (the offers were opened on the 19th of July 2010).
Investigations conclude/closed
During the last quarter of 2010, eight investigations
opened in previous years have been concluded, as follows:
1. The investigation on the possible infringement of art.5 (1) of the Competition Law and of art 101(1) of the Treaty on the functioning of the European union by CECCAR;
2. The investigation on the possible infringement of art.5 (1) of the Competition Law no.21/1996, republished by the undertaking operating on the market of accommodation and watering treatment services in Băile Olăneşti. These undertakings were involved in the tenders organised by the National House for Pensions and Other Social Security Grants for entrusting the treatment vouchers, subsidized from the State’s social security budget;
3. The investigation on the post services market concerning the CNPR’s abuse of dominant position;

4. Investigaţia privind posibilul abuz de poziţie dominantă al SC ELECTRICA SA pe piaţa serviciului de branşare a consumatorilor de energie electrică şi pe piaţa serviciului de închiriere a stâlpilor liniilor electrice de medie şi joasă tensiune pentru instalarea reţelelor de telecomunicaţii în România;
5. Investigaţia pe piaţa bancară (comisioanele practicate la utilizarea plăţilor cu carduri VISA şi MASTERCARD) referitoare la posibilul abuz de poziţie dominantă al băncilor/organizaţiilor Visa şi Mastercard prin stabilirea comisioanelor pentru tranzacţiile realizate la punctele de vânzare (în cazul folosirii cardului ca instrument de plată);
6. Investigaţia pe întreaga piaţa siderurgică cu suspiciunea de abuz de poziţie dominantă al societăţilor care activează pe această piaţă care a
extins investigaţia declanşată în urma unei plângeri pe piaţa producţiei de oţel ;
7. Investigaţia pe piaţa serviciilor de transport
persoane în regim de taxi în mun. Constanţa.

Politica de clemenţă
CC a acordat prima imunitate la amendă în cadrul investigaţiei pe piaţa taximetriei din Timişoara. Compania Radio Taxi a denunţat un cartel privind

4. The investigation on the possible abuse of dominant position of SC ELECTRICA SA on the following services markets: connection of consumers to power networks and law and medium voltage poles rental for the installation of telecommunication networks in Romania;
5. The investigation on the banking market (the fees related to the VISA and MASTERCARD card payments) on the possible abuse of dominant position of the banks/organisations Visa and Mastercard through setting the level of the fees related to the transactions made within the selling points (when the cards are used as a payment tool);
6. The investigation on the steel market focused on the possible abuse of dominant position of the undertakings activating on this market, which has
extended a previous investigation opened on the
steel market following a certain complaint;
7. The investigation on the taxi transportation market
in Constanţa;
8. The investigation on the taxi transportation market
in Timişoara
The leniency policy
The Competition Council has granted the first 100% fine immunity within the investigation on the taxi transportation market in Timişoara. The Radio Taxi Company had informed

majorarea tarifelor pentru serviciile de transport persoane în regim de taxi şi a beneficiat de imunitate totală la amendă.

Au fost efectuate 9 inspecţii inopinate la 124 de sedii/puncte
de lucru aparţinând unui număr de 94 de întreprinderi.
Avize
În luna decembrie, Consiliul Concurenţei a analizat în plen prevederile proiectului de O.U.G. de modificare şi comple-tare a Legii farmaciei nr.266/2008.În urma analizei, a fost avizat favorabil proiectul de O.U.G., cu condiţia ca la înfiinţarea unei farmacii în mediul urban, criteriul demographic să fie menţinut doar pe termen de un an, respective păna la data de 31 decembrie 2011, inclusiv.
Puncte de vedere
Au fost comunicate 5 puncte de vedere ale Consiliului
Concurenţei:
1. Punct de vedere solicitat de ANCOM referitor la definirea pieţelor relevante susceptibile de reglementare ex-ante corespunzătoare serviciilor de linii închiriate - segmente terminale - şi cu privire la analizarea situaţiei concurenţiale pe pieţele astfel identificate, în conformitate cu cadrul naţional şi european în vigoare.

9 dawn raids have been carried out at 124 de headquarters/

Biding opinions
In December, the Plenum of the Competition Council has examined the provisions of the draft GEO for the amendment and completion of Pharmacy Law no.266/2008.The draft GEO has received a favourable binding opinion, provided that the demographic criteria related to the establishment of pharmacies in urban areas will be maintained only for one year, namely until 31 December 2011.
Points of view
The following 5 points of view have been communicated
by the Competition Council:
1. Point of view requested by National Authority for Communications (ANCOM) on the definition of the relevant markets likely to be regulated in advance - line renting services – terminal segments – and on the analysis of the competition on these defined markets, based on the existing national and European framework.

În urma analizei, Consiliul Concurenţei a comunicat ANCOM acordul său cu privire la identificarea pieţelor relevante prezentate şi concluziile analizei constrângerilor concurenţiale pe pieţele identificate.
1. Punct de vedere referitor la modificarea Legii farmaciei nr.266/2008
Criteriul demografic şi cel teritorial prevăzute la înfiinţarea farmaciilor în mediul urban au ca rezultat limitarea accesu-
lui întreprinderilor pe piaţă, ceea ce înseamnă că numărul agenţilor economici care ar putea intra pe piaţă este mai mic decât numărul agenţilor economici care ar fi intrat în absenţa reglementării, afectând concurenţa pe piaţă. Pe lângă crite-riile menţionate, noua Lege a farmaciei prevede şi criteriul de
competenţă profesională, ceea ce înseamnă că înfiinţarea unei farmacii se poate face doar de către un farmacist, în calitate de asociat unic sau în asociaţie de farmacişti, care deţin cel puţin 51% din acţiuni. Introducerea unei astfel de
condiţii are ca rezultat discriminarea întreprinderilor care
intenţionează să intre pe piaţă în raport cu cele care deja
funcţionează pe piaţă.
Având în vedere posibilul impact al acestor criterii asupra
liberei concurenţe pe piaţă, Consiliul Concurenţei a cerut
Ministerului Sănătăţii să îi transmită proiectul de O.U.G. pri-
vind modificarea legii pentru emiterea unui aviz conform.
2. Punct de vedere către Ministerul Comunicaţiilor şi Societăţii Informaţionale referitor la proiectul de Hotărâre privind aprobarea dezvoltări i şi implementării Sistemului Naţional Electronic de Plată Online a Taxelor şi Impozitelor.

The Competition Council has communicated to ANCOM its approval on the identified relevant markets and on the conclusions of the analysis on the competitive constraints on the identified markets.
2. Point of view concerning the amendment of the Pharmacy Law no. 266/2008
The demographic and territorial criteria referred to the establishment of pharmacies in urban areas result
in limiting the access on the market, which means that the number of operators which could enter the market is less than the number of business that would enter in the absence of this regulation. Thus, the regulation affects the
market competition. In addition to these criteria, the new law also provides the competence criterion, which means that the establishment of a pharmacy can be done only by a pharmacist, acting as sole or in association with other pharmacists holding at least 51% of the stocks.The introduction of such a condition results in the
discrimination against the firms planning to enter the
market, compared to those already in the market.
Given the possible impact of these criteria on the free market
competition, the Competition Council has requested to
the Ministry of Health to submit its draft GEO in order to
receive the competition authority’s binding opinion.
3. Point of view in the attention of the Ministry of Communications and Informational Society concerning the draft Decision on the approval of the development and implementation of the National Online Tax Payment System.

Consiliul Concurenţei nu a identificat posibile probleme de concurenţă care să necesite intervenţia sa.
3. Punct de vedere referitor la O.U.G. nr. 109/2005 privind transporturile rutiere care, în urma modificării prin OUG nr. 74/2008, aprobată cu modificări şi completări prin Legea nr. 218/2009 afectează activitatea instructorilor auto autorizaţi.
4. Punct de vedere către Ministerul Sănătăţii şi, spre informare, Cabinetul Primului Ministru, referitor la proiectul O.U.G. privind modificarea Legii farmaciei (reintroducerea criteriului demografic, teritorial şi de proprietate la înfiinţarea de farmacii).
Consiliul Concurenţei consideră că menţinerea criteriului demografic la înfiinţarea unei farmacii în mediul urban trebuie limitată la 1 an.

The Competition Council has not identified any competition issues that would necessitate its intervention.
4. Point of view concerning GEO no.109/2005 on road transportation which, following its amendment through GEO no.74/2008 – prior approved with amendments by Law no.218/2009 -, affects the activity of the authorised driving instructors.
5. Point of view in the attention of the Ministry of Health and for the information of the Prime Minister’s Cabinet concerning the GEO on the amendment of the Pharmacy Law (reintroduction of the demographic, territorial and property criteria).
The Competition Council considers that the maintaining of the demographic criteria in establishing pharmacies in urban areas must be limited to 1 year.

Experţi ai Consiliului Concurenţei au participat la un număr de 20 de reuniuni de lucru şi consultări tehnice şi au elaborat 59 de opinii scrise în domeniul ajutorului de stat.
A fost acordată consultanţă de specialitate autorităţilor publice centrale în vederea elaborării a 17 acte normative, cu respectarea prevederilor legale în domeniul ajutorului de stat. Dintre acestea menţionăm:
Legea nr. 332/2009 pentru aprobarea O.U.G. nr.54/2009 privind stabilirea unor măsuri temporare în domeniul gazelor naturale;
Legea nr.88/2010 privind aprobarea unor măsuri financiare pentru întreprinderile mici şi mijlocii din industria berii;

In close collaboration with the European Commission, the Competition Council has elaborated responses to certain information requests of the European Commission, out of which we are mentioning:
1. the case of S.C. OLTCHIM S.A. Râmnicu Vâlcea;
2. the State aid scheme for the development of the air transportation infrastructure;
3. the case of S.C. AUTOMOBILE CRAIOVA S.A.;
4. the State aid scheme for cinematography;
5. the draft decision on the State aid measures designed to facilitate the closing of the non-competitive coal mines;
6. the notification of the State aid for restructuring the small and medium-sized enterprises active in the beer industry.

de stat ce conţin fonduri structurale
Consiliul Concurenţei a acordat asistenţă de specialitate Autorităţii de Management din cadrul Programului Operaţional Regional, Programului Operaţional “Creşterea Competitivităţii Economice”, Programului Operaţional “Dezvoltarea Resurselor Umane”, experţilor Ministerului Dezvoltării Regionale şi Turismului, Ministerului Economiei, Comerţului şi Mediului de Afaceri. Discuţii tehnice în domeniul ajutorului de stat au avut loc între experţi ai autorităţii de concurenţă şi cei ai Ministerului Dezvoltării Regionale şi Turismului. În cadrul acestora au fost analizate posibilele elemente de ajutor de stat conţinute de programele de cooperare teritorială internaţională desfăşurate de către minister.

În data de 19 octombrie a avut loc cea de-a IV-a întâlnire CIAS în cadrul căreia s-a analizat eficienţa şi oportunitatea menţinerii măsurilor de ajutor de stat autorizate şi neimplementate, blocate sau aflate în diferite etape de implementare sau care în actuala conjunctură economică nu-şi mai pot atinge scopul pentru care au fost alocate.

Consultancy for the State aid schemes
involving Structural Funds
The Competition Council has granted specialized assistance for the Management Authority within the Regional Operational Programme, the Operational Programme “Increase of the Economic Competitiveness”, the Operational Programme “Development of Human Resources”, for the experts of the Ministry of Regional Development and Tourism, and of the Ministry of Economy, Commerce and Business Environment. Technical discussions in the State aid field have been carried out between experts of the competition authority and of the Ministry of Regional Development and Tourism, focused on analysing the possible State aid elements provided by the international territorial cooperation programmes carried out by the ministry.

on the State aid Policy (CIAS)
The 4th reunion of CIAS has been organised on the 19th October. It has focused on analysing the efficiency and the opportunity of maintaining the authorised but not yet implemented State aid measures, that have been blocked or are in different stages of implementation or that can not longer attain the intended goal due to the present economic situation.

Reprezentanţi ai autorităţii de concurenţă au participat la un număr de 245 de acţiuni de promovare a culturii concurenţei, din care 225 organizate de către inspectoratele teritoriale ale Consiliului Concurenţei. Au fost invitaţi să participe reprezentanţi ai autorităţilor publice centrale şi locale, dar şi ai mediului de afaceri, academic şi juridic.
